I think the original ruling was based on the court feeling Maryland and DC didn't have standing. The three judge panel were all republican appointees. I am not a lawyer either but I find it really hard to believe these two entities don't have standing for their suit. I suspect the rest of the court felt the same way.

It's an interesting 'standing' argument.
Pretty unique situation, so that's why there isn't 'precedent' on this one.
I think it could go either way.
I'd hope that the courts all the way up the ladder will support standing but I'm not a lawyer either!
