Do you imagine that I have an issue with going outdoors and getting some exercise (I do a lot of bike riding too, tennis yesterday as well) and other ways to get some enjoyment and fresh air?...yes, physically distanced.

Here is the opening to the State of Georgia's brief, in response to Syd Kraken'up:

"Plaintiffs, a group of disappointed Republican presidential electors, filed a Complaint alleging widespread fraud in the November general election in Georgia, weaving an unsupported tale of “ballot stuffing,” the switching of votes by an “algorithm” uploaded to the state’s electronic voting equipment that switched votes from President Trump to Joe Biden, hacking by foreign actors from Iran and China, and other nefarious acts by unnamed actors. Plaintiffs did not bring this election challenge in state court as provided by Georgia’s Election Code. Instead, they ask this Court to change the election outcome by judicial fiat and order the Governor, the Secretary, and the State Election Board to “de-certify” the results of the election and replace the presidential electors for Joe Biden (who were selected by a majority of Georgia voters by popular vote as provided by state law) with presidential electors for President Trump. Their claims would be extraordinary if true, but they are not. This seems very odd to me. If, in fact, Alito’s initial order set a deadline of December 9 at 4 PM for the respondent’s brief, I don’t understand why he would yesterday or today move that deadline up.

If I were writing the brief, I would be really pissed off. Extremely unfair to first tell the lawyer he has until Wednesday at 4 PM, and then move the deadline up a day and a half around two days before the new due date for the brief.

Maybe the earlier reporting of the December 9 deadline was wrong, although that doesn’t seem to be the case.

So what to make of this? It still seems extremely unlikely to me that the court is going to step in and interfere with Pennsylvania’s decision to certify the results.

To hold the Pennsylvania mail in statute unconstitutional would be wrong for at least two reasons. First, the Pennsylvania legislature certainly has the constitutional authority to pass a statute permitting mail in voting. Second, if Pennsylvania’s law is unconstitutional, then does that make every other mail in law in the country unconstitutional? Obviously, that can’t be the case.

Maybe Justice Alito simply feels that the court needs to have time to act before the Safeharbor deadline passes. If the decision is going to be that the Pennsylvania Supreme Court’s decision is upheld, that would be fine. But if the court is going to try to muck up the process in some respect, that would be exceedingly unfair given the impending Safeharbor deadline. That deadline was critical to the court in Bush v. Gore. Why wouldn’t it still be critical?

Thanks for the response. It all seems rather jenky to me as a lay person.

I do not understand how you would run an election with a set of rules. The electorate participates with that set of rules. Now you’d say the rules are no good? People in good faith played by the rules they were given. Again seems rather jenky to me.

Plus weren’t these same rules used in the primary?

In fact, the legislation was passed last year (2019). Kelly waited to challenge the mail in law until after T**** lost Pennsylvania, which is why the Pennsylvania Supreme Court dismissed the lawsuit on laches grounds. Kelly could have filed this lawsuit last year, or many many months ago.

His lawsuit only raises state law issues. The US Supreme Court has no business interfering with the ruling of the Pennsylvania Supreme Court on Pennsylvania state issues.
