That was an outstanding movie and a brilliant performance by Mr Griffith.

Yes. It was fabulous. I first heard about it from a college professor in the early 1990s. I finally saw it 4 years ago. Brilliant. Anyone who believes the media doesn’t influence their decisions is still asleep. That movie predicted the future. Right down to Viagra.cradleandshoot wrote: ↑Sun Oct 11, 2020 10:13 amThat was an outstanding movie and a brilliant performance by Mr Griffith.

As predicted, attorneys for President Trump have asked the Supreme Court for an emergency application to stay – or put on hold – the recent decision by a Second Circuit Appeals court to let Manhattan District Attorney Cy Vance get Trump’s tax documents pursuant to a grand jury subpoena, as expected.njbill wrote: ↑Wed Oct 07, 2020 12:43 pm Copy of Second Circuit’s decision.

Do the Supremes even take this one?
Re: Orange Duce
My prediction is that Roberts holds this application until after the election and that they then will deny the request for a stay. The second circuit’s stay will remain in effect until the Supreme Court rules on this application.

Re: Orange Duce
If Roberts and the Court has made that judgment, why would they wait?
I realize that they don't want to be in the business of being considered 'political' but would not this waiting give exactly that impression?
It's not as if they're bound by DOJ rules etc (as if DOJ actually is any more).
Is there some SCOTUS principle that would establish such as precedent?
Frankly, I don't think it matters a hill of beans whether they wait or not, this is all going to come out with time. And it won't be before the election.
Re: Orange Duce
I think Roberts would see it as being the best way to keep from roiling the waters a couple of weeks before the election.
If the court were to deny the application, the headlines and pundits would say “the supreme court rules against Trump!!” That really wouldn’t be what the court would’ve done so I think Roberts would want to avoid that type of reaction.
Plus, I think Vance would get the stuff before the election, probably right away. Would anything leak out? It shouldn’t, and in the normal grand jury case it wouldn’t, but who knows what would happen here?
And even if it did, would the leaks be substantively any different than the NYT articles? I don’t think so.
True, the substantive effect (possible indictments) of Vance getting the materials won’t be known for some months or longer, but there would still be the big news that Trump had finally lost his tax return battle.
Plus, if Roberts waits and Trump loses the election, at some level it will be easier for the court to deny the application.
Now, similar reasoning would suggest that Sullivan will wait to issue his Flynn decision until after the election. My guess is he won’t, however. I think he will rule before November 3.

I do understand the logic, of course, and the prediction as to Roberts' most likely choice.
and Sullivan's.
I'm simply challenging the integrity of that logic (not you or Roberts), as, if the judgement is already made, the decision to delay is itself a political act.

Re: Orange Duce
I understand your point. If we were to put Roberts on a rack, he would say his decision is to protect the institution and keep it as apolitical as possible.
Frankly, I don’t have a huge disagreement with that approach although I do agree with you that it would be better for the court to rule when they make their decision.
Maybe they will. Maybe my prediction will be wrong.
