Judge Andrew Napolitano: We’ve lost sight of basic constitutional norms – Does Trump understand that?
Three events took place last week -- all at the hands of President Donald Trump -- and each warrants examination from the Madisionian perspective as each assaults limited government and rejects the separation of powers. Each, as well, involves the accumulation of unconstitutional power in the branch of government that Madison feared the most.
Trump ordered acting secretary of defense Patrick Shanahan not to purchase a missile defense system that Congress had authorized and directed him to purchase -- and to which Trump had agreed -- but to divert that missile-budgeted money to build a fence along a 50-mile stretch of the 1,900-mile Texas/Mexico border. The secretary has publicly indicated that he will comply.
In the same breath last week, the president also ordered the acting secretary to deploy troops to assist the Border Patrol to enforce immigration laws at the Texas/Mexico border. This, too, is unlawful because among the laws Trump swore to uphold is a federal statute prohibiting the use of the military for domestic law enforcement.
Also, last week, the president announced the imposition of a 25 percent tariff on nearly all goods entering the U.S. from China. This, too, he did on his own, even though under the Constitution only Congress can impose taxes. Is the tariff a tax by another name? Trump argues that the Chinese government will be paying billions into the U.S. Treasury and he can then spend that money however he wishes.
Trump is wrong again. First, the tariffs are collected at the border and are initially paid directly by the Chinese seller, not the Chinese government. The seller then passes the tariff cost on to American consumers, who purchase the goods on which the tariffs have been imposed. The tariff is actually a sales tax, which will increase by 25 percent the cost of any product purchased in America that originated in China.
Maybe VDH can explain to the author, an actual expert on constitutional law, how wrong he is. :lol:

Last April, President Donald Trump announced, “We’re going to be guarding our border with the military” until congressional support for funding a U.S.-Mexico border wall can be secured. This led to the deployment of state National Guard personnel to the border. During this deployment, they are acting under state legal authorities (so called “Title 32” authorities, referencing the title in U.S. Code). In response to the April deployment, I wrote a piece, titled The Military, Mexican Border and Posse Comitatus: Four Key Takeaways, which provided general guidance concerning what troops were legally permitted to do on the border.

Trump double-downed on his vision for a more militarized border last week. In the lead up to the midterm elections, and in response to a U.S.-bound immigrant “caravan” fleeing Central American violence, Trump has now ordered active-duty military forces (so called “Title 10 forces”) to the U.S.-Mexican border. Unlike the earlier use of state National Guard personnel – whose deployment to the border continues – the use of federal forces operating under federal control raises two additional issues concerning:

(1) what kind of support the “Title 10 military” can provide to law enforcement; and

(2) rules for the use of force.

1. First, unlike “Title 32” National Guardsmen and women, “Title 10” active-duty military personnel under federal control are largely prohibited from taking an active and direct role in law enforcement activities. And for good reason: The Posse Comitatus Act has been in place since 1878 and prohibits any part of the Army or Air Force from “execut[ing] the laws.” The Department of Defense has extended this prohibition on taking an active role in law enforcement to the Navy and Marine Corps by regulation (but not the Coast Guard). So any direct involvement in law enforcement – think of a search, seizure, apprehension or arrest – would violate the Posse Comitatus Act as well as governing military directives. That’s a no-go.

The military border mission, named Operation Faithful Patriot, is best described as “defense support of civil authorities” where indirect assistance to law enforcement is authorized, but direct assistance is not. Prohibited direct assistance to law enforcement includes using force or physical violence and discharging or using a weapon (except in self-defense). And traditional law enforcement functions to include evidence collection, security functions, and manning and staffing checkpoints are also prohibited based upon existing directives.

Indirect assistance is authorized. This could potentially include providing and operating military equipment, sharing information with Customs and Border Patrol officials, aerial reconnaissance, and detecting and monitoring the immigration flow. But the laws and governing regulations authorizing this support date from the “War on Drugs” in the 1980s. They were passed with the specific goal of easing military restrictions to overwhelmed law enforcement officials in response to illicit drug trafficking entering the United States.

Perhaps most importantly, we all need to take a step back on the real or perceived “threat.” The immigrants who eventually make their way to the border... include families, children, and people who will be physically and mentally exhausted. They will be in need of food, water, and medical assistance. Thankfully, the military is well-equipped and trained to provide such humanitarian assistance. Hopefully, there will not be any need to make difficult decisions about life and death.

The Pentagon is preparing to approve a loosening of rules that bar troops from interacting with migrants entering the United States, expanding the military’s involvement in President Donald Trump’s operation along the southern border.

Senior Defense Department officials have recommended that acting defense secretary Patrick Shanahan approve a new request from the Department of Homeland Security to provide military lawyers, cooks and drivers to assist with handling a surge of migrants along the southern border.

The move would require authorizing waivers for more than 300 troops to a long-standing policy prohibiting military personnel from coming into contact with migrants.

The Pentagon has approved only one previous request to waive the policy since the beginning of Trump’s recent border buildup, in order to provide migrants with emergency medical care if required. There are about 2,900 active-duty and 2,000 National Guard troops along the border.

Don’t Give Trump Too Much Credit for the Soaring Economy
Mr. Trump is abnormal.

The reasons are manifold and simple: He lies about almost everything, defies the law, violates the Constitution, disparages our foreign allies, stokes fear of immigrants, disses every American who is not in his base, carries on embarrassing bromances with murderous dictators like Vladimir Putin and Kim Jong Un, and places an incredible array of crooks and grifters in high positions. I could go on.

One of the few things Mr. Trump doesn’t lie about, however, is the economy. It really is in great shape. Does he deserve credit?

GDP growth in the first nine quarters of the Trump presidency has averaged 2.77%—versus 2.3% over the 16 quarters of Barack Obama’s second term. A growth gap of 47 basis points over nine quarters is neither a revolution nor a revelation, but it’s certainly worth having. Furthermore, the lion’s share of that gap can be accounted for by faster growth in business investment.

The eye of the beholder no doubt matters here. But to me the total impact on GDP from deregulation looks small. Remember, the acceleration we seek to explain is only 47 basis points, and the tax cut and more federal spending account for most of that.

On balance, Mr. Trump’s economic policies probably boosted GDP growth a bit. But that growth came at the cost of an exploding federal budget deficit, several fateful steps down the road to environmental degradation, and reduced protections for workers, consumers, the poor, and small investors—not to mention defaming the Constitution and disgracing America in the eyes of the free world. The polling paradox is hardly mysterious.

Trumps economic policies??? Please. He inherited a sting economic inertia. So trend line or important.

His tax bill provided a huge fiscal stimulus with a huge increase in deficit. If the Republican Congress not prevented an infrastructure program he would have inherited an even stronger economy. But deficits..,,

The opportunity cost inflicted on the country is significant. Growth has been suppressed, cost of maintain e is pushing out new projects and repair backlogs are growing rapidly.

His policies with Iran and others drives up the price of gasoline. His tariffs are the largest tax increases in years, his deficits are record setting and are reallocation share of wealth to the top reducing demand below what it would have been. The interest on the national debt and his China policy will likely drive up interest rates or at least keep them above where they might have been. China’s holding of US debt are at s two year low.

His tax bill is credited by both the CBO and WSJ as going nothing more than providing a sugar high. GDP slowed every quarter last year.

Unemployment is dropping because people are leaving the labor force and are no longer part of the equation. Job growth is replacing job loss but that is about it. Wages continue to be pretty much stagnant and purchasing power is at s level of the 70s.

The maker is not the economy.

GDP alone is not enough. Growth in the economy is very very very unevenly distributed. But whatever

Michael Flynn provided clear evidence of attempted obstruction. Trump wants investigators jailed after that was reported. He goes ballistic every time he is caught stealing cookies.

Also wants tax payers to pay Taliban expenses for attending talks. What the heck?
