Kavanaughty is the furthest thing from a victim. I wouldn't consider any of Harriet Miers, Douglas Ginsburg, Bork or Thomas a victim either.

Brett signed up for this by accepting the SCOTUS nomination. No one forced him to play this game -- he volunteered. He should in no way be surprised or offended if his past bad behavior is being dredged up. I have no idea whether Brett actually assaulted anyone -- that's what testimony and investigation are supposed to uncover.

It does seem clear that he was (at a minimum) an entitled d-bag frat boy with a tendency to get blind drunk frequently. How surprising he didn't go to Duke instead of Yale. : )

I'd be inclined to cut him some slack for that if he'd have copped to "when I was young and stupid I was...young and stupid." If I were Trump, I'd cut Kavanaughty loose today and go with Amy Coney Barrett, who would be #metoo proof. And she'd more likely than Brett to overturn RvW. If you want someone to get that job done, hire a woman to do it.

How would you feel if someone accused you of sexual assault/rape and there was no evidence and you did not do it. I don't think the first thought by anyone involved was "this woman is lying". It seems to me that the first reaction was, will you please come in and tell your story. As she dissembled and drew out the timeline/process; the lack of corroboration of he story became more and more clear.

There is also the very real possibility that we are witnessing a bit of backlash to the title IX witch hunts that have gone on on college campuses, where the boy is guilty until proven innocent and offered no rights to a fair hearing.

A presumption of innocence is a virtue this country was founded upon. I cannot fault anyone for wanting to adhere to that standard.

I believe it has already done damage for women...and possibly everyone. If she does not come out truthful on this (i) it shows bad for women in general, (ii) definitely shows bad for politics and the left, and (iii) it sets us all up that innuendo = guilt/not competent until proven otherwise. That IMO, is bad doe everyone.....especially our children. The positive side, if there is one, is that anyone claiming/having been assaulted MUST seek the authorities, if for no other reason than historical documentation. Guaranteed tenure for life. Can only be removed from office via impeachment. Can retire at any time and will continue to get full pay for life. Plush public sector health insurance and perqs. All that applies to a DC Circuit judge (what BK is now and what he woud stay if not confirmed) and also a SCOTUS justice. DC Circuit pays $221k a year; SCOTUS pays $255k a year. Not much diff. You get a COLA salary adjustment every year. And Article III, Section 1 says it is unconstitutional to ever have your pay reduced.

BK isn't losing his job/livelihood. He's got a cush set up either way. And he could resign from the bench and make much more in private practice if he ever desired to do that.
