Kittila [i.e. MAGA hack] replied by explaining that the exhibits have been publicly available for weeks on the House Ways and Means website. Kittila then accused a staff member of Clark's office of impersonating someone from Kittila’s staff in a call to the clerk of the Delaware court and asking to have the letter removed from court filings.
Clark [HB's lawyer and formerly a Latham partner] responded by acknowledging that someone from one of the firms representing Hunter Biden [i.e. Latham & Watkins] had called the clerk but said she did not misrepresent herself and had said who she was and why she was calling.
The judge then asked the clerk, who backed up Kittila’s explanation of what happened. The judge then asked Clark to explain what happened or possibly face sanctions.
Late Tuesday, the [Latham] staff member filed an affidavit with the court explaining that the mix-up was in the clerk’s office and provided details of what she said, her notes and the call records.

So it seems more likely that the dirty trickster here was the GOP counsel who was trying to get publicity inappropriately. The judge, of course, has full access to that filing in order to consider it before she rules.]

Shortly thereafter, Bengels [of LW] submitted an affidavit blaming the miscommunication on the court clerks.
“I am completely confident that I never indicated that I was calling from Mr. Kittila’s firm or that I worked with him in any way,” she said. “The only mention of his name was when [the clerk] had asked me if the filings had been entered by Mr. Kittila’s firm and I answered that I believed that to be the case.”
“We have no idea how the misunderstanding occurred, but our understanding is there was no misrepresentation,” Hunter’s legal team said in a letter to the judge.
“We hope this letter and the attached declaration dispels any suggestion that undersigned counsel or our staff would ever intentionally misrepresent or mislead the Court with respect to any matter,” they added.

... so it looks like the plea agreement is dead. Seems the judge was looking after Hunter's best interest, or a very cleaver gambit. In any case I got the impression the issue of who impersonated what/who/when was not a concern of the judge.

Not so fast, cradle. Looks like the plea agreement is back on although Hunter isn’t getting the assurance that he certainly wanted which was that this agreement concludes all criminal investigations involving him.
