SCOTUS punts abortion pill ruling until Friday.

Probably means that various justices are writing concurrences and dissents.

Still have to believe that they will completely stay the crazy TX judge's whacko ruling pending full appeal. But who knows.

And whatever the ruling, we know that multiple justices will be letting us know exactly how they feel about this case.

... guessing 5-4 to stay. Kavanaugh and Roberts care that its some pretty poor "judging".

Reproductive rights, is a strange thing to call, what, in actuality, IS anything BUT producing.

I have lots of plants growing, hoping to "reproduce" about 20 pounds,,,,,easy.

Yeah, we really can't have the voters decide anything.

Current law, requiring 50.1%, has been in place for over 100 years. But the threshhold needs to be urgently raised to 60% before November. Why?

Because voter initiated refernda on abortion and gerrymandering are coming this fall.

The minority has to keep changing the rules to keep the majority from ousting the control of the shrinking minority.

Pathetic but entirely expected.

I'd push those initiatives to 2024 -- to get all those angry suburban women turned out then.

State's which have banned abortion have seen an average 10.5% drop in OB/GYN residency applicants over the last 9 months. It will get worse. The ability to recruit other specialties will follow. Whatcha gonna do for doctors?

Cranky Sam just being snarky and clapping back against the libs. Whatever Sam.

Key point is that SCOTUS has said in advance they will keep the stay in place, regardless of the 5th circuit decision, so long as SCOTUS accepts a cert petition. That only requires four votes and the majority today was 5 to 7 votes.

I read that as a coded message to the 5th circuit that SCOTUS expects it to dispose of this case. Probably on standing grounds. If not by the three judge panel then by an en bank decision.

If the 5th does not handle, then SCOTUS will take the case. Which means the stay stays in place until SCOTUS finally decides the case next term. That might not be until June 2024. Which is election season.

Could get interesting if the 5th circuit does not end the Amarillo madness.

Nope. It was an unsigned opinion -- not unusual for emergency/preliminary/temporary orders.

We know that Alito and Thomas dissented. No surprise.

We know there were at least 5 votes for the indefinite stay. Presumably three libs plus Roberts plus ???.

One of ACB, Gorsuch or Kav had to be the fifth vote.

No idea what the other two votes were. So it could have been 5-4 or 6-3 or 7-2.

P.S. the 5th circuit appeal will be heard by a different three judge panel than the three who made the interim order last week. Another tbd in how this thing may work out.

Alito proves, again, that he is really nothing more or less than a right wing culture warrior, whose time on the Court is simply aimed at bending the world to his medieval world views. This line in his dissent:

"...here, the Government has not dispelled legitimate doubts that it would even obey an unfavorable order in these cases...."

An Associate Justice of the Supreme Court blithely casting doubt on a democratically elected administration's fidelity to the rule of law, based on nothing but his Leonard Leo ventriloquism. And in the context of an opinion in which the medical needs of women, and the standard operating procedures of the pharmaceutical industry are thrown to the side of the road from Sam's fast moving car. This is where we are today.

A hypothetical future injury that rests on a series of conjectures does not establish standing. A judge cannot toss out real scientific evidence in favor of baseless propaganda. And no court can simply yank a drug from the market by overriding FDA approval —which is why no court has ever tried to do so until now. When the abortion bans began, there were 9 maternal-fetal medicine physicians in the state of Idaho. Now there are only 4, less than a year later. Same work load. The largest hospital in the state, previously well thought of hospital used to get dozens of applications for physician vacancies, make a single offer that would always be taken. Now they have a vacancy and receive one or two applications that are not good fits.

Cosmically dumbass republiCONs. :lol: :lol:
