PMM's closing line -- ...it’s very hard for anyone to get their mind around this investigation.

She makes that painfully obvious in her writing. She needs to start with an exec summary of her premise, then walk through the legal citations which support it. We're not getting paid by the hour to dissect her rambling dissertations, especially when she lumps together several cases with key differences.

The last couple of weeks have yielded a flood of insights about what, exactly, happened in the lead-up to the January 6 insurrection, and they paint a picture of a president who would do anything—*anything—*to stay in office. A lot of people had long suspected that Trump would use dubious means to remain in power, but there was no concrete proof of an attempted coup until now. This was not a coup like the one in Myanmar where the military seized the government, nor was this coup successful, because our democratic institutions held. But just because Trump’s attempt didn’t work this time doesn’t mean that it won’t work the next.

I don't know. But it's all a good question...there have indeed been massive costs in response to the threat of insurrection, a threat that most couldn't even imagine in America prior to Jan 6.

But was it "unnecessary" or did that massive deployment effectively discourage any chance of the insurrection continuing violently at the Capitol?

After all, you keep complaining that they didn't do such deployment before Jan 6.

Had they done so, probably would have prevented that 10,000 strong mob from actually succeeding in breaching the Capitol...on the other hand, it might have led to more of them bringing AR-15's to the scene...or taking and using the weapons of NG members...

They actually came extraordinarily close to "success", including in the effort to provide a legal patina justifying the coup (Trump appointees balked, thank god), the effort to enlist the military through DoD leadership (Trump appointees, esp. Milley, balked), the efforts at the state levels (GOP governors and Secs of State and Trump appointed judges balked) and in the violence reaching members of Congress and the VP (50 yds). Any of these be successful and the coup may well have succeeded or led to full outright civil war.

Way, way too close.

Trump plots an insurrection and fails spectacularly

On December 12th, with Proud Boys marching through downtown Washington in mock-military formations shouting "Move out!" and "1776!" Trump tweeted
"Wow! Thousands of people forming in Washington (D.C.) for Stop the Steal. Didn't know about this, but I'll be seeing them! #MAGA." A bit later, he tweeted, "WE HAVE JUST BEGUN TO FIGHT!!!"
...seven days later, on Dec. 19, Trump was tweeting
"Big protest in D.C. on January 6th. Be there, will be wild!"
The next week, on Dec. 26, he tweeted
"The 'Justice' Department and the FBI have done nothing about the 2020 Presidential Election Voter Fraud, the biggest SCAM in our nation's history, despite overwhelming evidence. They should be ashamed. History will remember. Never give up. See everyone in D.C. on January 6th."
On Jan. 1, the day he met with Jeffrey Clark to discuss firing Rosen, he tweeted
"The BIG Protest Rally in Washington, D.C. will take place at 11:00 A.M. on January 6th. Locational details to follow. StopTheSteal!"
Trump's problem, to put it frankly, was that he didn't start committing crimes early enough. The crimes he committed in December and January were largely impulsive, not carefully planned or focused. He exploded with tweets and phone calls and meetings and rallies.

In short, Trump was Trump, as incompetent a criminal conspirator as he was a president. The only question left to be answered at this point is whether Merrick Garland and the Biden Department of Justice will have the courage to charge him and his co-conspirators with the felonies they committed: defrauding the United States by attempting to illegally influence the outcome of the 2020 election.


You can sit back and call it "Trump Hatred" or "TDS" all you want, the guy is a criminal and very likely will be charged, indicted and jailed for these crimes against American Democracy. Incitement to Insurrection.

That wasn't the deployment needed before Jan 6th. They needed to better organize & deploy the available police assets, like they do for NSSE's. Use NG to augment police doing traffic control & guarding Fed buildings not targeted for protest, freeing up more police for crowd control. Activate police & Fed agency tactical teams, in advance. Have a plan for all the desk bound Fed agents to grab a weapon & vest, organized to respond, as many did, on their own initiative, as DC Metro plain clothes officer Fannone did. Deploy the Secret Service K-9's from the WH. There should be fire mains in the Capitol building, 3 high pressure hose teams at the top steps could have kept the steps clear, just as they are used to repel small boats, boarders, & pirates aboard ship. Overwatch SWAT snipers, starting with rubber bullets could have dropped a few of the first wave, blocking the rest. How many weapons did the protesters bring ? After Jan 6th, the NG troops guarding the lampposts were visibly armed. Now many AR-15's showed up in response ?

If this ever gets to an indictment of Trump and other high level government officials, the problem will be finding any group of twelve citizens where none have the pre-conception that Trump actually won.

My fear is our country may find itself in an even worse situation If indictments are made at such a high level and a jury doesn’t convict. Then we have to deal with a new spin that an acquittal means Trump et al were justified in what they did.

I also think that an indictment of Trump for criminal incitement over the January 6 violence is risky, and risks acquittal, which Trump and his Apostles will translate into -- among the Fact-Free support crowd -- grievance against the State. Trump seems more likely to be indicted on the election warping efforts in Georgia, which keep mounting up.

Trump intended to fire him for refusing to say that widespread voter fraud had been found in Georgia, according to a person familiar with his testimony.

Mr. Pak, who provided more than three hours of closed-door testimony to the Senate Judiciary Committee, stepped down with no notice on Jan. 4, saying that he had done his best “to be thoughtful and consistent, and to provide justice for my fellow citizens in a fair, effective and efficient manner.”

While he did not discuss Mr. Trump’s role in his decision to resign at the time, he told the Senate panel that the president had been dismayed that Mr. Pak had investigated allegations of voter fraud in Fulton County, Ga., and not found evidence to support them, according to the person familiar with the statements.

Mr. Pak testified that top department officials had made clear that Mr. Trump intended to fire him over his refusal to say that the results in Georgia had been undermined by voter fraud, the person said. Resigning would pre-empt a public dismissal.

During a phone call with Secretary of State Brad Raffensperger of Georgia on Jan. 2, two days before Mr. Pak resigned, Mr. Trump asked Mr. Raffensperger to find enough votes to reverse the state’s presidential election results and described fraud allegations that Mr. Raffensperger said were not supported by facts, according to leaked audio of the call.

Mr. Pak had refused to support similar election fraud claims because of the lack of evidence, according to two people familiar with his investigation. “You have your never-Trumper U.S. attorney there,” Mr. Trump told Mr. Raffensperger during their phone call.

Audio of that call was leaked to The Washington Post on Sunday, Jan. 3, just hours before Mr. Trump met with top Justice Department officials to discuss the possibility of replacing the acting attorney general, Jeffrey A. Rosen, with Jeffrey Clark, a department leader who was willing to falsely tell Georgia officials that fraud might have affected the election outcome.

While Mr. Rosen and Mr. Clark argued at the meeting about which man should lead the Justice Department and whether the department should intervene in Georgia, Mr. Trump interjected with complaints about the department’s official conclusion that the state election results were valid, according to three people briefed on the meeting. Mr. Trump ultimately decided not to elevate Mr. Clark, and the department did not send Georgia officials a letter seeking to undermine Mr. Biden’s win.

Donoghue, sent an email to Mr. Pak at 10:09 p.m. that said, “Please call ASAP,” according to documents that the House Oversight and Reform Committee obtained from the Justice Department and released in June.

Although Mr. Trump’s allegations of a stolen election have died in the courts and election officials of both parties from every state have said there is no evidence of fraud, Republicans across the country continued to spread conspiracy theories. Those include 147 House Republicans who voted against certifying the election.

Intervention at the Justice Department. Rebuffed by ranking Republicans and cabinet officials like Attorney General William P. Barr, who stepped down weeks before his tenure was to end, Mr. Trump sought other avenues to peddle his unfounded claims. In a bid to advance his personal agenda, Mr. Trump plotted to oust the acting attorney general and pressed top officials to declare that the election was corrupt. His chief of staff pushed the department to investigate an array of outlandish and unfounded conspiracy theories that held that Mr. Trump had been the victor.

Pressuring state officials to 'find votes.' As the president continued to refuse to concede the election, his most loyal backers proclaimed Jan. 6, when Congress convened to formalize Mr. Biden's electoral victory, as a day of reckoning. On that day, Mr. Trump delivered an incendiary speech to thousands of his supporters hours before a mob of loyalists violently stormed the Capitol.

During that phone call, Mr. Donoghue relayed that Mr. Trump remained fixated on the false notion that he had won Georgia, and said the president was angry that Mr. Pak did not support that conclusion, according to a person familiar with the call.

Early the next morning, Mr. Pak sent Mr. Donoghue resignation letters addressed to Mr. Trump and Mr. Rosen, effective immediately.

Senator Richard Blumenthal, Democrat of Connecticut and a member of the Judiciary Committee, said on Wednesday that Mr. Pak had “answered all questions in a seemingly honest and candid way, and my impression is that he believes in the rule of law and that he stood up for it.”

Mr. Blumenthal and Senator Jon Ossoff, Democrat of Georgia, were among a handful of committee members who listened to all of Mr. Pak’s testimony.

While the panel’s investigation is ongoing, it has completed its first set of interviews. They included Mr. Pak, Mr. Donoghue and Mr. Rosen, who spoke with the committee for nearly seven hours and with the Justice Department’s inspector general for about two hours.

Mr. Clark has not said whether he will come in for an interview, and the committee has not indicated who else it wants to speak with. The Justice Department has said that it will not invoke executive privilege if former officials are asked to testify before congressional investigators."
